Two Kenya Defence Forces Service Personnel have been arraigned in a Court Martial at Kahawa Garrison for offences related to indulging in recruitment maltipractises. The two were arraigned before Judge Advocate Diana Mochache on 15 and 16 September 2021.
The first accused, Sergeant Robert Kipkemoi of Recruits Training School (RTS) was accused of two accounts of soliciting money on different dates between 9th February 2021 and 11th April 2021 from a civilian, Mr Joseph Kimutai Choge and his daughter Mercy Chepkemoi Choge a recruit at Recruits Training School on pretext that he had influenced her recruitment into the Kenya Defence Forces.
It is alleged that Sergeant Kipkemoi had approached the duo after the recently concluded recruitment exercise to solicit for the money. He pleaded not guilty to the charges and requested an advocate to represent him in the next hearing. The case was therefore adjourned to 24th September 2021.
Retired -Redeployed Non-Commissioned Officer 3 Henry Wafula Wanyonyi of Defence Forces Technical College (DEFTEC) was also arraigned for the offence of committing a civil offence under Section 133 (1) (b) of the Kenya Defence Forces Act 2012 for obtaining money by false pretence contrary to Section 3313 of the Penal Code.
RRNCO Wanyonyi was accused of unlawfully obtaining money on different dates between 5th January 2021 and 10th April 2021 from Miss Rezzie Namulanda in Malava within Kakamega County and her son Toywa Bravine as recruitment inducement for her son into the Kenya Defence Forces.
The accused was alleged to have unlawfully obtained a sum of Kshs 275,450 from Miss Rezzie Namulanda and later Kshs 50,000 from Toywa Bravine to help secure recruitment into the KDF.
Henry pleaded not guilty to the charges. The case was adjourned to 21st October 2021 when the hearing will take place.
The court prosecutor Lieutenant Colonel Henry Mugiira insisted on the need for Serving Personnel to maintain discipline and integrity during the recruitment process to avoid such occurrences but also insisted that prosecutions will be carried for those who participate in recruitment malpractices as a way of punishment and deterrence.
